§ 30-21. Civil penalty.

  • Any owner or owner's representative with control over the premises violating any provision of or any proclamation, rule, regulation, order or directive issued under this chapter upon proof that: (1) the defendant was actually notified of the provisions of this section or of any proclamation, rule, regulation, order or directive issued under this chapter; and (2) after the defendant received notice of the chapter, proclamation, rule, regulation, order or directive, the person committed acts in violation of same or failed to take action necessary for compliance may be assessed a civil penalty not exceeding $1,000.00 a day for violation or a civil penalty not to exceed $5,000.00 a day for violations relating to point source effluent limitations or the discharge of a pollutant, other than from a non-point source, into a sewer system, including a sanitary or stormwater sewer system, owned or controlled by the town or assessed a civil penalty as may otherwise be authorized by law.
